Battle Lines on Fast Lanes, Interconnections, and Mergers Are Blurring

May 9th, 2014

After the leak of Tom Wheeler’s proposed FCC net neutrality replacement and the commercially reasonable fast lanes it would supposedly allow, it was only a matter of time before the opposition overcame its initial stunned reaction.  It has become hard to separate the debates about interconnection/peering, the Comcast/TWC merger, and the proposed new rules.  The players overlap so much and it’s all the same infrastructure, so whatever the logical overlap the battlefield is becoming a shared one. May 2nd, 2014

Last week it leaked that the FCC under Tom Wheeler may be preparing a new version of network neutrality rules that could allow content companies and last mile operators to enter into ‘commercially reasonable’ agreements for preferential traffic treatment.  Wheeler has since clarified that the bar for  ‘commercially reasonable’ would be very high, but nevertheless it would clearly stand the status quo on its head.  It has been long enough for the initial dust to settle, and it’s Friday so it’s time for a poll.   [Read more →]
